Public comments on EPBC Act referrals

Australia’s national environmental law is called the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act).

Under subsection 74(3) of the EPBC Act, the Minister for the Environment invites anyone to provide a comment on whether the proposed action is a controlled action.

A new way of submitting public comments on EPBC Act referrals was launched in April 2022.

The online EPBC Act Public Portal replaced the EPBC Act Public Notices and Have Your Say pages. It is designed to improve the way we process referrals and capture feedback under the EPBC Act. As a member of the public, you'll be able to follow a projects progress and comment when you have the opportunity.

Public comments for projects submitted in the new EPBC Act Business Portal will be made through the new EPBC Act Public Portal.
