The Industrial Chemicals Environmental Management Standard (IChEMS) is a national approach to managing chemical use, storage, handling and disposal. It will deliver more consistent environmental regulation and make it easier for industry to choose less harmful chemicals.

We asked for your feedback on the draft decision-making Principles to be established by legislative instrument under the Industrial Chemicals Environmental Management (Register) Act 2021.

These Principles will guide scheduling decisions for chemicals. They are the basis for classification of a chemical into one of seven schedules and for setting any management standards that apply to a chemical.

What happens next

We will review your feedback and consider all responses when finalising the Principles.

After the Principles are finalised, the next step is consultation on proposed individual scheduling decisions.

After this, chemicals can be categorised and scheduled on the IChEMS Register based on their level of concern to the environment. This will help government, industry, and the community make informed choices about chemicals.

Background

In March 2021, the Australian Government passed the Industrial Chemicals Environmental Management (Register) Act 2021 (ICEMR Act). The ICEMR Act allows the Minister to establish the IChEMS Register, where scheduling decisions regarding environmental management of industrial chemicals will be recorded.

Previous consultation

Consultation on an earlier draft of the principles was a part of a formal public comment process in January 2020. Prior to this, extensive consultation occurred with stakeholders and states and territories.

Section 24 of the ICEMR Act requires that before making, varying or revoking the Principles, public comment must be sought for a period of not less than 20 business days.
